Anyone who commits a felony in this strange strip of land (hidden away in eastern Idaho) can do so “with impunity,” thanks to an extremely unhelpful Constitutional provision. Idaho House Representative Colin Nash explained to the state legislature, “under the legal theory, if there is no one that lives in…this 50-square-mile swath of Yellowstone Park, there would be no constitutionally legitimate jury to be seated so that person could be tried.” So if you’re heading out to Yellowstone backcountry, may we suggest stocking up on extra safety gear?
